License Agreement

Welcome to Doriana Designs! By purchasing, downloading and displaying digital and physical art products from our collection, you are agreeing to the terms of this License Agreement. Please read the following terms carefully.

I. Doriana Designs Digital Art License Agreement

Grant of License 

This License Agreement grants you, the purchaser, a non-exclusive, non-transferable, single-user license to use the digital art (“Licensed Material”) purchased from Doriana Designs for personal, non-commercial use only.

Multiple License Seats

Each purchase of a digital art product from Doriana Designs grants a single-user license for personal use. If you wish to obtain additional licenses for different users, you may select the desired quantity during checkout. Each additional item represents a new license seat for a separate user.

Please Note:

  • Each user must agree to the terms of the License Agreement.
  • Redistribution of the digital art file among multiple users is not permitted under a single-user license.

For organizations or groups requiring multiple licenses, please make separate purchases for each item and their corresponding license seat.

Permitted Uses

  • Personal Display: Displaying the Licensed Material as wallpaper on any and all personal electronic devices owned by you. This includes, but is not limited to, smartphones, tablets, laptops, desktop computers, and smart TVs.
    • The Licensed Material may only be used on devices that are personally owned and controlled by you.
    • You may not transfer, share, or display the Licensed Material on devices not owned by you.
  • Personal Modification: Making personal modifications to the Licensed Material, such as altering the design, color, size, or format to fit your devices.
    • Any modifications must be for personal use only and may not be shared or distributed.
    • Modified versions of the Licensed Material cannot be used for commercial purposes or public display.
    • You may not claim ownership of the original or modified Licensed Material, as all rights remain with Doriana Designs.
  • Backup: Creating a reasonable number of backup copies of the Licensed Material for personal use in case of device failure.
    • The copies must be stored securely and must not be made available to others.
    • The backup copies carry the same license restrictions as the original Licensed Material and are subject to all terms and conditions of this License Agreement.

Forbidden Uses

  • Commercial Use: Using the Licensed Material for any commercial purpose, including but not limited to advertising, marketing, or as part of a product for sale.
  • Redistribution: Redistributing, reselling, leasing, licensing, or sub-licensing the Licensed Material, such as, but not limited to, sharing the digital art file with friends, uploading it to file-sharing websites, or any form of distribution.
  • Public Display: Publicly displaying the Licensed Material without proper attribution to Doriana Designs.
  • Derivative Works: Creating derivative works from the Licensed Material for commercial use or public display.

    Social Media Use

    • Permitted Social Media Use:
      • Profile and Cover Photos: You are allowed to use the digital art as your personal profile picture or cover photo on social media platforms, with proper attribution to Doriana Designs.
      • Personal Posts: You may post the digital art on your personal social media accounts, provided the posts are not for commercial purposes and proper attribution to Doriana Designs is given.
    • Forbidden Social Media Use:
      • Commercial Use: You may not use the digital art to promote businesses, products, or services on social media.
      • File Distribution: Sharing the actual digital art files or providing a means to download the art through social media is strictly prohibited.
      • Misrepresentation: Claiming ownership of the digital art or using it in a way that implies endorsement by Doriana Designs without permission is not allowed.

    Attribution

    • Proper attribution to Doriana Designs is required when the Licensed Material is used in a public setting or shared on social media.
    • The attribution should be clear and legible, stating “Artwork provided by Doriana Designs” and, where possible, include a link back to our website.
    • Attribution should be placed in close proximity to where the Licensed Material is displayed or within a credits section if applicable.

    Updates to Digital Art

    Doriana Designs strives to provide the highest quality digital art for your personal enjoyment. Once a piece of digital art is purchased and downloaded, it is considered a final sale. We do not typically provide updates to our digital art pieces, as each artwork is a unique creation and sold as-is.

    • In the event that an artwork is updated or replaced with a new version, customers who have purchased the original artwork will not automatically receive access to the updated version.
    • Any updates or new versions of an artwork will be treated as separate products and may require a separate purchase.

    Technical Support

    • Doriana Designs offers technical support for issues related to downloading and accessing the Licensed Material.
    • The client is responsible for setting up the digital art as wallpaper on their devices.

    Termination for Misuse

    • Misuse of the Licensed Material will result in a written notice and a period to remedy the situation.
    • Continued misuse after notice will lead to termination of the License Agreement and revocation of all rights granted.
    • Upon termination, you must immediately cease all use of the Licensed Material and destroy all copies.

    Intellectual Property

    • All Licensed Materials are the property of Doriana Designs and are protected by copyright, trademark, and other Romania and international intellectual property laws. Your purchase of the Licensed Material does not constitute a transfer of title.

    Disclaimer of Warranties and Limitation of Liability

    • The Licensed Material is provided “as is” without warranties of any kind, either express or implied, including, without limitation, warranties of merchantability or fitness for a particular purpose.
    • To the maximum extent permitted by law, Doriana Designs shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the Licensed Material.

    General

    • This License Agreement constitutes the entire agreement between you and Doriana Designs.
    • If any provision of this License Agreement is deemed invalid, the remaining provisions will remain in full force and effect.

      II. Doriana Designs Physical Art License Agreement

      Grant of License

      This License Agreement grants you, the purchaser, a non-exclusive, non-transferable, single-user license to display the physical art (“Licensed Material”) purchased from Doriana Designs for personal, non-commercial use only.

      Attribution

      • Proper attribution to Doriana Designs is required when the Licensed Material is used in a public setting or shared on social media.
      • The attribution should be clear and legible, stating “Artwork provided by Doriana Designs,” and, where possible, include a link back to our website.
      • Attribution should be placed in close proximity to where the Licensed Material is displayed or within a credits section if applicable.

      Permitted Uses

       

      • Personal Display: 

        Displaying the Licensed Material as wall art in your personal spaces (e.g., home, office, or studio).
        • The Licensed Material may only be used in locations owned or controlled by you.
        • You may not transfer, share, or display the Licensed Material in public spaces or locations not owned by you.
      • Personal Modification: Making minor adjustments to fit the physical dimensions of your chosen frame or display area.
        • Any modifications must be for personal use only and may not be reproduced or distributed.

      Forbidden Uses

      • Commercial Use: Using the Licensed Material for any commercial purpose, including resale, advertising, or marketing.
      • Redistribution: Reselling, leasing, licensing, or sub-licensing the Licensed Material.
      • Public Display Beyond Personal Spaces: Publicly displaying the Licensed Material in commercial venues, galleries, or public exhibitions.
      • Derivative Works for Commercial Purposes: Creating derivative works from the Licensed Material for commercial use.

      Color Variations and Minor Differences

      • Due to printing processes and variations in display settings, there may be slight color differences between the digital representation and the physical product.
      • Minor variations in size, texture, or appearance are inherent to the printing and framing process and do not affect the overall quality of the artwork.

      Termination for Misuse

      • Misuse of the Licensed Material will result in a written notice and a period to remedy the situation.
      • Continued misuse after notice will lead to termination of the License Agreement and revocation of all rights granted.
      • Upon termination, you must immediately cease all use of the Licensed Material and destroy all copies.

      Intellectual Property

      • All Licensed Materials are the property of Doriana Designs and are protected by copyright, trademark, and other Romania and international intellectual property laws.
